The defence attorney of the accused Gilgo Beach serial killer, Rex Heuermann, has suggested moving the highly anticipated trial to Mars in search of an impartial jury. Attorney Michael Brown made the light-hearted comment outside the Suffolk County Courthouse in Riverhead, New York, following a status hearing where the judge hinted at setting a trial date.
Brown expressed concerns about finding a fair and unbiased jury given the widespread media coverage and statements made by law enforcement officials that may have influenced potential jurors. He emphasised the importance of ensuring a fair trial for his client.
Heuermann, a 60-year-old architect from Massapequa Park, is facing charges in connection with the murders of six women. During the hearing, he appeared in court dressed formally and without family members present in the gallery. He has been held without bail since his arrest in July 2023.
This marked Heuermann’s second court appearance since his arraignment on charges related to the murders. His estranged wife, Asa Ellerup, was not in court and is reportedly staying in South Carolina with their son and service dog.
The Suffolk County District Attorney disclosed that a significant amount of data extracted from electronic devices has been turned over to the defence. However, the DA expressed concerns about resource limitations and funding issues impacting the timeline for the case.
The case is scheduled to return to court on December 17, where the judge aims to set a trial date. Additionally, a “fry hearing” is set for the spring to determine the admissibility of certain DNA evidence in the trial.
Heuermann’s attorney plans to file a motion to separate the cases involving the last two victims from the initial four victims. The defence team is navigating legal complexities surrounding evidence and technological advancements in DNA analysis.
The prosecutor highlighted challenges posed by the investigation’s scope and resource constraints, including frozen assets impacting the case. The request for additional funding from the Department of Justice was mentioned to support the prosecution in resolving the complex serial killer case.
