SpaceX, the aeronautics company founded by billionaire Elon Musk, has filed a lawsuit against a California regulator, alleging “naked political discrimination” that led to a decision blocking additional rocket launches from the Vandenberg Space Force Base. The lawsuit, spanning 45 pages and filed in California’s central district, accuses the California Coastal Commission of violating free speech rights and disregarding federal policies and laws.
During an October 10 hearing, SpaceX claims that commissioners explicitly mentioned Musk’s political views as the basis for their decision. The company’s attorneys described the commission’s political bias as evident and unprecedented, asserting that the decision was a means to penalise SpaceX for Musk’s statements and beliefs.
According to SpaceX, it is highly unusual for a government body to showcase such overt political bias in its decision-making process. The company argues that the commission overstepped its authority by punishing SpaceX based on the political views of its major shareholder and CEO.
In response to the lawsuit, the California Coastal Commission declined to provide a comment, and requests for feedback from SpaceX and the Vandenberg Space Force Base went unanswered. Musk, known for his outspoken nature, criticised the commission’s decision on social media, calling it unlawful and urging members to resign immediately.
The commission’s denial of SpaceX’s request to increase rocket launches at the Vandenberg Space Force Base sparked the legal battle. Despite the setback, SpaceX highlights its efforts to mitigate environmental impacts and comply with coastal resource protection regulations, particularly concerning the use of rocket-grade kerosene as propellant.
Commissioner Gretchen Newsom, unrelated to the California governor, cited Musk’s social media activity and SpaceX’s safety record during the hearing. She also raised concerns about Musk’s alleged anti-California sentiments, prompting further scrutiny of SpaceX’s operations in the state.
