A self-proclaimed Nazi has made history by becoming the first person in the Australian state of Victoria to be convicted for performing an outlawed Nazi salute. Jacob Hersant, a 25-year-old man, raised his arm in the banned salute and praised Nazi leader Adolf Hitler in front of media cameras outside the Victoria County Court on October 27, 2023, following an unrelated court appearance. This incident occurred just six days after the Victorian state government had officially declared the Nazi salute illegal.
The Federal Parliament had passed legislation in December criminalizing the public display of the Nazi salute or any Nazi hate symbols nationwide. Despite arguments from Hersant’s defence lawyers that the gesture was not a salute and that the ban infringed upon his right to political communication, a Melbourne magistrate found him guilty. Hersant is facing a potential sentence of 12 months in prison and a fine, with the hearing scheduled for the following day.
Earlier in June, three men were convicted for performing the Nazi salute during a soccer match in Sydney on October 1, 2022. The state of New South Wales had already banned Nazi symbols the previous year. Although the men were fined and have since lodged appeals, Hersant has indicated his intention to potentially appeal to a higher court.
Speaking to reporters outside the court, Hersant admitted his Nazi ideology and expressed his defiance by stating that he would continue to give the salute, albeit discreetly. Dvir Abramovich, chair of the Anti-Defamation Commission and a staunch advocate against antisemitism in Australia, welcomed the verdict as a significant step towards upholding justice and decency in society.
