Two former Memphis officers did not testify at their trial in the case of Tyre Nichols’ death, while one could still take the stand to testify. Lawyers representing the ex-officers rested their cases without calling them to testify in their defense against charges of violating Tyre Nichols’ civil rights. Nichols tragically passed away following a fatal beating after a traffic stop in 2023.
The trial, now in its fourth week, saw attorneys for Tadarrius Bean and Demetrius Haley informing the jury that they would not be calling any more witnesses. Both officers’ attorneys had previously brought forward police use-of-force experts to justify their actions during the traffic stop and subsequent beating. On the other hand, Justin Smith’s legal team had indicated that Smith would testify in his defense. However, Smith has not yet taken the stand.
During the trial, Jared Zwickey, a law enforcement expert witness, analysed video evidence and showed excerpts to the jury of Smith and Bean’s actions towards Nichols. Zwickey testified that Smith’s actions were in accordance with Memphis police and national policing standards and training. The officers involved in Nichols’ death were part of the Scorpion Unit, which focused on tackling drugs, illegal firearms, and violent criminals. Following Nichols’ tragic death, the Scorpion Unit was disbanded.
Two officers from the unit, Desmond Mills and Emmitt Martin, pleaded guilty and testified for the prosecutors. Smith, described as the team leader for Scorpion Unit One, was reported to have instructed “hit him” during the beating. This statement has been contested by prosecutors who argue it contradicts departmental policy and training.
Nichols, a Black man, was subjected to pepper spray and a Taser during the traffic stop before attempting to flee. The officers, also Black, then proceeded to physically assault Nichols, resulting in his death three days later. Witnesses have described Nichols pleas for help as he was being punched, kicked, and hit near his home. The autopsy report confirmed Nichols died from head injuries sustained during the incident.
Haley, Bean, and Smith have pleaded not guilty to federal charges including excessive force, failure to intervene, and obstructing justice through witness tampering. Additionally, the officers have been charged with second-degree murder in state court, where Mills and Martin are anticipated to change their pleas. As investigations and legal proceedings continue, the community awaits further developments in this troubling case.
