Texas has taken legal action against a Dallas doctor, accusing her of providing gender-affirming care to transgender youths in violation of a state ban. This lawsuit is one of the first instances where a state is actively seeking to enforce bans on gender-affirming care, a measure predominantly championed by Republicans in recent times.
The legal action, spearheaded by Texas Attorney General Ken Paxton, alleges that Dr. May Lau supplied hormones to over 20 minors, contravening a Texas ban that came into effect last year. According to Harper Seldin from the ACLU’s LGBTQ & HIV Project, this marks the inaugural attempt by Texas to enforce such legislation, with no other states reported to have pursued similar measures. The lawsuit, filed in suburban Collin County, aims to clamp down on the provision of hormone therapies, puberty blockers, and transition surgeries to transgender individuals under 18, although surgeries on children are typically rare.
While the specifics of the case were not commented on, the lawsuit signifies the consequences of the ban as highlighted by Seldin, who deems it a “predictable and terrifying result.” The ACLU had previously challenged the law to prevent scenarios where doctors feel vulnerable to government targeting for exercising medical judgment. Dr. May Lau, who works as an associate professor in the pediatrics department at UT Southwestern Medical Center in Dallas, is accused in the lawsuit of falsifying medical records, prescriptions, and billing records to misrepresent the nature of testosterone prescriptions for minors.
The lawsuit seeks an injunction against Dr. Lau and proposes fines of up to $10,000 per violation. Neither Dr. Lau nor UT Southwestern have responded to requests for comments thus far, while Children’s Health, where Dr. Lau holds hospital privileges, stated that it abides by all state healthcare laws. Notably, around 26 states have introduced laws limiting or prohibiting gender-affirming medical care for transgender minors, with many of these laws facing legal challenges. While federal judges have invalidated bans in states like Arkansas and Florida, the situation remains contentious with ongoing legal battles and temporary blocks on enforcement in certain states.
The lawsuit emerges in the run-up to an impending election where Republicans have leveraged opposition to gender-affirming healthcare to discredit their opponents. Figures like Sen. Ted Cruz have used support for transgender rights as a point of contention. The Texan ban, endorsed by Governor Greg Abbott, has notably included investigations into families of transgender minors seeking gender-affirming care. The political landscape surrounding this issue remains heated, with stark divisions evident between Republicans and Democrats on matters of transgender healthcare legislation.
