A young man from Paisley has requested a jail sentence to address his alcohol problem after assaulting a bus driver. Ben Birch, 22, was heavily under the influence when he boarded a McGill’s bus in Paisley’s Smithhills Street on June 4 last year. Birch, who was topless, refused to pay for a ticket and when confronted, threw powder at the driver’s face and subjected him to racial abuse. The entire incident was captured on CCTV, as detailed by prosecutor Matt Piskorz at Paisley Sheriff Court.
The driver informed Birch of the ticket requirement, but Birch refused to acknowledge it, leading to a confrontation. Birch then threw powder at the driver’s face and verbally abused him before police were called. Defence agent Terry Gallanagh stated that Birch was deeply ashamed of his actions and sought a custodial sentence to address his alcohol issues. Despite his remorse, Sheriff Amel Elfallah criticised Birch’s behaviour, highlighting the impact on the driver and passengers.
Sheriff Elfallah acknowledged Birch’s early plea, age, and previous convictions but deemed custody appropriate due to the assault on a public service worker. He sentenced Birch to 220 days in jail, reduced from 330 days. Birch apologised for his actions, acknowledging the right of individuals to work without fear of abuse. This incident underscores the importance of addressing alcohol-related issues and respecting individuals in the community. Such actions have consequences, and the court aims to uphold accountability.
