UK watchdog to take mattress seller Emma to court over online discounting

The UK’s competition watchdog is preparing to escalate the issue with mattress seller Emma to court due to concerns over its online discounting tactics that could potentially mislead consumers. The Competition and Markets Authority (CMA) commenced an investigation into Emma two years ago, focusing on practices such as countdown timers and high demand prompts that could create false urgency for shoppers.

The CMA’s probe unearthed that Emma’s website showcased substantial discount offers, yet only a small portion of its products were actually sold at full price. Despite being instructed to amend its “reference pricing” strategies, which indicate if a product was previously sold at a higher price, Emma allegedly failed to fully comply with the CMA’s requirements for change.

A representative for Emma clarified that while the company has made several adjustments as requested by the CMA, including modifying the use of countdowns and discontinuing other urgency tactics, the watchdog also desires restrictions on the volume of products sold at a discounted price compared to the full price. Emma believes that implementing such restrictions could deprive UK consumers of optimal deals and disrupt promotions.

George Lusty, the interim executive director for consumer protection and markets at the CMA, expressed concerns about the potential for misleading sales tactics to prompt impulsive purchases and unnecessary spending by consumers. Despite the CMA’s current inability to levy fines directly for breaching consumer law, legal action has been initiated against Emma for its non-compliance.

Emma retains the option to agree to changes beforehand or give commitments to the court prior to the hearing. The court will subsequently assess whether Emma has violated consumer protection regulations. The date for the court hearing will be determined in due course.
