Lawyer of Former SNP MP Natalie McGarry Cleared of Misconduct in Legal Advice to Fraudster
A lawyer has been cleared of professional misconduct regarding legal advice provided to former SNP MP and convicted fraudster Natalie McGarry. Matthew Berlow represented McGarry from 2018 to 2019 after she faced charges of fraud and embezzlement while serving as an MP. An investigation was initiated by the Law Society of Scotland, following five conduct issues raised by the Scottish Legal Complaints Commission regarding Berlow’s handling of McGarry’s case.
The Law Society’s inquiry found unsatisfactory professional conduct on Berlow’s part for not arranging alternative representation when McGarry’s advocate was unavailable for her trial, resulting in a £1500 fine. Allegations included Berlow’s failure to consult with or advise McGarry on her prosecution during a nine-month period in 2018 leading up to her trial at Glasgow Sheriff Court. Additionally, he was accused of not acting in her best interests when he withdrew from representing her just before her trial in April 2019.
Despite these complaints, no further action has been taken by the Law Society against Berlow. McGarry was found guilty in 2022 of stealing funds while holding positions within political organizations, leading to a prison sentence. Following an appeal and retrial, McGarry was ultimately jailed for two years, of which she served 11 months.
Berlow expressed his satisfaction with the Law Society’s findings, stating, “I feel vindicated by this investigation and decision.”
McGarry, who served as MP for Glasgow East from 2015 to 2017, received substantial legal aid for her defense against the fraud charges. A Law Society of Scotland spokesperson emphasized the organization’s commitment to upholding regulatory standards within the legal profession.
