A Scottish nurse who tragically caused the death of a grandfather and his dog by hitting them with her car has managed to avoid a jail sentence. Pamela Kennedy, aged 35, struck Martin Cawley, aged 64, and his pet Zoe as they were crossing a road in Wellhouse, Glasgow on February 6, 2023. Kennedy stated that she swerved her red Nissan Micra to avoid hitting Zoe and did not see Mr. Cawley. She attempted to perform CPR on Mr. Cawley at the scene and was overheard pleading, “Don’t do this to me, you have got to live, this will affect my job if you die.”
Kennedy was found guilty of causing Mr. Cawley’s death by careless driving at Glasgow Sheriff Court. Her defence lawyer, Graham Mann, mentioned in court that she already had three points on her licence for speeding at the time of the incident. Sheriff Tony Kelly sentenced Kennedy to 300 hours of unpaid work, a six-month curfew from 7pm to 7am, a two-year driving ban, and 18 months of supervision. The sheriff acknowledged the impact statements from Mr. Cawley’s family, expressing the profound loss and long-lasting consequences they are experiencing.
During the trial, witnesses recounted the tragic event, with a 15-year-old boy and a 13-year-old girl who were nearby at the time of the accident. Kennedy reportedly told witnesses that she swerved to avoid the dog and did not see Mr. Cawley. Tragically, Mr. Cawley suffered fatal injuries and died at the scene, while Zoe had to be put to sleep the following day due to her injuries.
Kennedy, who is currently working as a bank nurse at a care home in Drumchapel, expressed her remorse through her lawyer, acknowledging the tragedy that Mr. Cawley’s family is enduring. Despite Kennedy’s punishment, the court recognised that no sentence could compensate for the profound loss suffered by Mr. Cawley and his family.
