Under the new divorce law, more than 80,000 divorces are expected to be granted this year, leading to potential challenges for separated or divorced parents traveling with children who have different surnames. Moore emphasised the complexities that separated parents face, especially during the holiday season when adjusting to new family dynamics. She stressed the importance of being prepared without any Court Orders in place, especially for parents with different surnames than their children. With concerns about child abduction and trafficking, the UK Visa and Immigration (UKVI) may require additional documentation to prove consent and relationship to the child.
To ensure a hassle-free travel experience, Moore recommended several key documents to carry, including passports, Court Orders allowing solo travel, consent letters from non-accompanying parents, birth certificates, and marriage certificates or divorce Final Orders. All holders of Parental Responsibility must consent to their child traveling abroad, except in cases where specific Court Orders grant permission. Moore advised parents to check airline requirements, local embassy regulations, and destination country requirements to prevent any issues while travelling.
In addition to legal considerations, it is essential for parents to stay informed about specific travel requirements of different countries, as regulations can vary. Moore suggested bringing sealed Court Orders, consent letters, birth certificates, and marriage certificates to the airport.
