A drink driver has been sentenced to three years in jail after causing a horrific crash in Newmains. Andrew Smart was driving at a speed of 85 miles per hour in a residential area when he lost control of his Ford Focus, resulting in a collision with two other vehicles. The crash left Smart, two of his passengers, and another driver with serious injuries. Smart, aged 31, pleaded guilty to dangerous driving at an excessively high speed while under the influence of alcohol.
The incident occurred at the junction of Overtown Road and Main Street around 8:30 pm on February 22 last year. Prosecutors stated that Smart attempted to turn left onto Main Street at high speed but failed to maintain control, colliding with a Vauxhall Corsa waiting at the junction, before crashing head-on into an Audi. Smart’s car caught fire, and members of the public had to assist in rescuing him from the vehicle.
One of Smart’s passengers suffered a broken arm and leg, burns to his torso and legs, while the other passenger sustained spinal, pelvic, and arm fractures, necessitating multiple surgeries. Smart himself suffered a spinal fracture, burns to his hands, and cuts to his face. The driver of the other vehicle involved suffered a broken ankle. Despite the strong smell of alcohol emanating from Smart at the scene, no blood sample was taken to confirm his intoxication level.
During the court hearing at Hamilton Sheriff Court, Smart’s defence lawyer indicated that Smart had no recollection of the crash and expressed deep remorse for his actions. The lawyer proposed a community disposal as a means to monitor Smart closely. However, Sheriff John Hamilton deemed Smart’s driving as severely reckless and highlighted the lack of accountability due to Smart’s memory loss surrounding the events. In addition to the three-year jail term, Smart was also banned from driving for six years and eight months and ordered to retake his driving test.
