Haulage Company Slapped with £242,000 Fine Following Tragic Lorry Crash

A haulage company has been hit with a hefty fine of £242,000 due to failures that resulted in the death of a Scottish grandfather. George Moran, also known as Dode, lost his life in a harrowing crash involving a lorry on the A92 in Tayside on August 22, 2020. The tragic incident occurred when mooring buoys came loose from the lorry and fell onto Mr. Moran’s car, leading to his fatal collision near Kinnaber. Mr. Moran, aged 53, was pronounced dead at the scene, while his wife Pamela sustained serious injuries in the crash.

Investigations revealed that the collision was caused by a mooring buoy, being transported by Colin Lawson Transport Limited (CLT), becoming detached and striking Mr. Moran’s vehicle. This incident resulted in the loss of Mr. Moran’s life and caused severe injuries, permanent disfigurement, and permanent impairment to his wife, Pamela. Furthermore, four months later, another incident involving a poorly secured load on a CLT lorry led to the vehicle tipping over and damaging a wall on the A92 between Montrose and Stonehaven near Johnshaven.

A thorough investigation into the company’s practices by authorities including Police Scotland, the Crown Office and Procurator Fiscal Service, and the Health and Safety Executive uncovered that CLT had failed to adequately assess the risks associated with transporting loads. Additionally, the company had not implemented suitable measures or provided sufficient training to its employees on securing transported loads effectively.

Following their admission of failing to ensure the proper securing of transported loads between August and December 2020, CLT was fined a total of £241,875. Debbie Carroll, leading health and safety investigations for the COPFS, highlighted that the tragic loss of Mr. Moran’s life could have been prevented with proper risk recognition and safety measures in place. The sentencing serves as a stark reminder that negligence in load securing can have devastating consequences.

Mr. Moran was affectionately described as a cherished grandfather by his family and friends, with many expressing their shock and sorrow over his untimely passing. His daughter shared heartfelt memories and sentiments, while others paid tribute to his kind and gentle nature.
