A Vermont sheriff is facing retrial on an assault charge for kicking a shackled detainee twice in the groin back in 2022. The sheriff, John Grismore, was a captain at the time of the incident before he was elected as sheriff in November 2022. The case resulted in a mistrial back in July, prompting a second trial to commence.
The latest trial began with jury selection on Monday afternoon. In the initial trial in July, the jury failed to reach a unanimous decision after four hours of deliberation, leading to the mistrial. Grismore expressed disappointment at the jury’s inability to acquit him following the first trial but refrained from commenting on the ongoing retrial.
The incident in question occurred when a video surfaced showing Grismore kicking a shackled detainee who refused to stay seated at the sheriff’s office. The detainee was handcuffed and shackled when Grismore kicked him in the groin twice, once while he was seated and again when he stood up.
Following the incident, Grismore was fired from his position as a captain before being elected as sheriff. He pleaded not guilty to the simple assault charge brought against him. In December 2023, the Vermont Criminal Justice Council determined that Grismore had violated the state’s use of force policy, leading to a 15-1 vote to permanently revoke his law enforcement certification.
Despite recommendations from a special legislative committee advising against impeachment, Grismore refused to step down from his position as sheriff, citing support from Franklin County voters and residents. The committee expressed concerns that Grismore’s continuation in office was a disservice to the community.
