A former police officer’s gunshots during the deadly raid on Breonna Taylor’s apartment put several lives at risk, federal prosecutors argued on Monday. The prosecutors made their case during the opening statements of Brett Hankison’s retrial in a U.S. District Court in Louisville. This retrial comes after the previous trial ended in a mistrial due to a jury deadlock.
Breonna Taylor, a 26-year-old Black woman, was fatally shot by police officers in March 2020 in a botched raid. In the chaotic events that unfolded, Hankison fired 10 shots into Taylor’s apartment, narrowly missing not just Taylor but also endangering her neighbours and even a fellow police officer, Myles Cosgrove, who fired the fatal shot that killed Taylor. Despite the hail of bullets, no one was injured by Hankison’s shots.
Assistant U.S. Attorney Anna Gotfryd highlighted the recklessness of Hankison’s actions, stating that he violated a fundamental police rule by shooting into a darkened space without a clear target. The prosecution’s narrative revolves around the fact that Hankison’s actions not only endangered those present but also showcased a disregard for basic safety protocols.
Hankison’s defence attorney, Jack Byrd, argued that his client was merely present at the raid with a drug-detection dog and was not directly involved in the decision-making process. Byrd contended that Hankison’s actions were aimed at protecting his fellow officers during the gunfire exchange that ensued.
The trial also heard from Myles Cosgrove, the officer who fired the fatal shot, who testified about the intensity of the situation during the raid. Cosgrove recounted the moments leading up to Taylor’s death, emphasizing the dangers he faced as gunfire erupted in the apartment. He testified that some of Hankison’s shots came uncomfortably close to where he stood, underscoring the chaotic and perilous nature of the raid.
Witness testimonies further painted a vivid picture of the terror that night, with one neighbour describing how Hankison’s stray bullets pierced her apartment walls and shattered her sliding glass door, causing her deep distress and subsequent diagnosis of post-traumatic stress disorder.
As the trial progresses, Hankison faces the possibility of a life sentence if convicted on the federal charges against him. The courtroom proceedings shed light on the tragic events of that fateful night, underscoring the need for accountability and justice in cases of police misconduct and endangerment of civilian lives.
