Ex-St. Louis Prosecutor Admits Misuse of Public Funds and Avoids Criminal Charges
A former St. Louis prosecutor, who previously faced criticism for her handling of cases, has admitted to misusing thousands of dollars in public funds to pay herself back. The federal authorities revealed on Wednesday that Kim Gardner, a former Democratic prosecutor, will not face criminal charges as long as she repays the misused $5,004 and adheres to the conditions of a pretrial diversion agreement.
Gardner, who resigned amidst controversies last year, was the first Black circuit attorney elected in the city in 2016. As part of a movement of progressive prosecutors, she advocated for reforms such as diversion to mental health treatment for low-level crimes and holding police more accountable. However, her tenure was marked by clashes with Republican leaders, including criticisms of low conviction rates in homicide cases and high office turnover.
One of the notable cases during Gardner’s term was the charging of former Governor Eric Greitens with felony invasion of privacy in 2018, which was later dropped. Scrutiny of this case led to the conviction of one of Gardner’s investigators and a reprimand from the Missouri Supreme Court. Despite facing financial penalties and disciplinary action, Gardner’s troubles with public funds arose when she directed employees to issue checks from a public fund for her personal reimbursement.
