**Scots Beauty Entrepreneur Awarded £50k Compensation After Unfair Dismissal**

A Scottish beauty entrepreneur, Hayley Harvey-Smith, has successfully won over £50,000 in compensation after facing unfair dismissal for taking ‘working holidays’ while overseeing her beauty company. Hayley, the founder of a thriving beauty school, came under scrutiny for her extended trips to Bali, Australia, Paris, and Val d’Isere in France. Despite earning up to £220,000 annually and being allowed to take leave as she wished due to her directorial role, Hayley was later criticised by the new business owner, Mark Thompson, for her holiday and work arrangements. As a result, she was unjustly sacked under the guise of redundancy by the new owner, who took issue with her working holidays.

The tribunal ruling in Edinburgh determined that, except for the Val d’Isere trip, all of Hayley’s travels were considered working holidays and did not contravene any employment regulations. Consequently, Hayley filed a lawsuit against GlamCandy UK, her former company, for unfair dismissal and unpaid accrued holidays, resulting in a compensation award of £51,293. The tribunal revealed that Hayley played a pivotal role in the business she co-founded, managing various aspects such as marketing, social media, and product sourcing. Despite having a contractual annual leave allowance, she often worked beyond stipulated hours, even during her travels.

Despite the alleged breach of the ‘moonlighting’ clause by engaging in other business activities, the tribunal dismissed these claims, stating that Hayley did not violate any contractual obligations. Ultimately, the tribunal found Hayley’s dismissal to be unjust, as the redundancy process was deemed a sham. The judge ruled that there was no valid reason for her dismissal, deeming it unfair in the eyes of the law.

Hayley’s case sheds light on the complexities of entrepreneurship and employment dynamics, underscoring the importance of fair treatment and due process in workplace decisions.
