An NHS cleaner recently made headlines for taking 400 sick days over four years, resulting in her unfair dismissal. Zoe Kitching, the cleaner at Royal Lancaster Infirmary, faced extended periods off work due to mental health issues. Despite being considered disabled, her employer, University Hospitals of Morecambe Bay NHS Foundation Trust, did not recognise her status, leading to her dismissal. This case raises questions about sick leave policies in the UK.

In 2022, around 185.6 million working days were lost due to sickness in the UK, a significant increase from the previous year’s 149.8 million. Work-related injuries or illnesses accounted for approximately 33.7 million lost working days in Great Britain in 2023/24. The impact of long Covid has been substantial, with an estimated 1.8 million affected individuals. Mental health-related sick leave has also surged, with about 313,000 on extended leave in 2022 due to mental health issues.

Legal regulations surrounding sick leave in the UK do not set a specific limit on the number of sick days an employee can take. However, employers must adhere to statutory sick pay regulations, providing £109.40 per week for up to 28 weeks. Individual companies may have their own policies regarding sick leave, and extended absences are typically subject to investigation. Continuous sick leave could potentially lead to dismissal, highlighting the importance of understanding an employer’s sick leave guidelines.
