Scots nurse suspended over row with trans colleague tells tribunal she ‘felt intimidated’ getting changed

A nurse from Scotland who was suspended following a conflict with a transgender colleague over using a changing room testified at an employment tribunal, stating that she felt “embarrassed and intimidated.” Sandie Peggie, a nurse at NHS Fife for over 30 years, was placed on leave and then suspended after an incident with Dr. Beth Upton, who is a transgender woman. Peggie claims that being required to change beside Dr. Upton amounted to unlawful harassment under the Equality Act. She expressed feeling uncomfortable and intimidated when Dr. Upton began changing in the same room at Victoria Hospital, Kirkcaldy, in December 2023.

NHS Fife, however, disputes Peggie’s claims, describing the case as unnecessary and vexatious. NHS guidelines permit transgender individuals to use changing rooms corresponding to their gender identity. Peggie successfully argued for the tribunal to be held publicly, despite requests for privacy from Dr. Upton and NHS Fife to protect identities. The tribunal also allowed Peggie to refer to Dr. Upton as a man throughout the proceedings, under certain conditions.

Peggie recounted feeling uncomfortable during several encounters with Dr. Upton in the changing room, including incidents where other staff members expressed discomfort with Dr. Upton’s presence. Peggie alleged feeling embarrassed and intimidated, insisting that Dr. Upton had no right to use the female changing area. Following a complaint of bullying made against her, Peggie denies using offensive language and maintains she did not discriminate or harass Dr. Upton.

Throughout the tribunal, Peggie reiterated her concerns about Dr. Upton’s presence in the female changing room, while NHS Fife and Dr. Upton’s representative countered that the issue lay with Dr. Upton being in the changing room, not with any actions or words. The tribunal continues to address the case.
