Trans Doctor Feels Unsafe After Nurse’s Hurtful and Demeaning Comments in Changing Room
In a recent employment tribunal, a trans doctor shared her experience of feeling “unsafe” following allegedly hurtful and demeaning remarks made by a nurse in a changing room they both used at work. The nurse, identified as Sandie Peggie, allegedly compared Dr. Upton to a transgender rapist and insisted that Dr. Upton, as a man, should not be in the women’s changing room.
The incident took place on Christmas Eve 2023 at Victoria Hospital in Kirkcaldy, where the nurse, who has 30 years of service, lodged a complaint of sexual harassment or harassment related to protected beliefs under the Equality Act 2010. This led to her suspension in January 2024 after Dr. Upton accused her of bullying and harassment.
Dr. Upton, who transitioned in January 2022 and uses she/her pronouns, testified that Ms. Peggie’s comments left her feeling upset and distressed. Despite being out at work since August 2022, Dr. Upton encountered challenges due to her gender identity.
The tribunal heard how Ms. Peggie raised concerns about Dr. Upton’s presence in the women’s changing room, suggesting it was inappropriate and unsafe. Dr. Upton defended her right to use the facilities based on her identity as a woman, leading to a confrontation that escalated with Ms. Peggie’s comments about chromosomes and safety.
The doctor expressed feeling anxious and nervous, even experiencing a panic attack upon hearing of Ms. Peggie’s return to work post-suspension. Dr. Upton’s encounters with Ms. Peggie in the changing room resulted in a significant impact on her mental well-being, leading to sickness absence.
Despite generally positive experiences with colleagues, the doctor highlighted the challenges faced due to the public nature of the inquiry, which led to hostile articles and social media posts. The tribunal continues to address the allegations from both parties.
